The New York State Film Tax Credit Program

New York’s recently enhanced incentive program includes higher tax breaks, increased annual caps—and for the first time ever, qualifying above-the-line wage costs are eligible.

Production Incentives

Film productions which comply with requirements may be eligible for a tax credit of 30% percent of qualified production expenses, including certain above-the-line wages subject to specific caps, below-the-line wages, and production costs directly related to the production of a qualified film. Qualifying relocation costs are also eligible for TV series relocating to the state. The state’s production incentives are funded at $700 million a year through 2034.

Post-Production Incentives

Productions which comply with requirements may be eligible for a fully refundable tax credit of 30% of qualified post-production expenses. The Program is limited to the post-production of feature films, television series, relocated television series, television pilots, and films for television. This tax credit program is funded at $45 million a year through 2034.

Commercial Production Incentives

Credits of up to $7 million per year can be allocated to encourage qualified production companies to produce commercials in New York State. Production companies producing commercial in New York can receive a credit of up to 30% on qualified production expenses, including pre- and post-production costs and most below-the-line items including costs of technical and crew production, expenditures for facilities, props, makeup, wardrobe, set construction, and background talent.
